House Oversight Committee Chairman James Comer (R-KY) has issued a subpoena to Dr. Kevin O’Connor, President Biden’s former physician, requiring his testimony as part of an ongoing investigation into whether the White House misrepresented the president’s health during his final year in office.
The subpoena, served on Thursday, compels Dr. O’Connor to appear for a deposition on June 27, after he declined to participate in a voluntary interview requested by the committee last month.
In the letter accompanying the subpoena, Comer cited O’Connor’s 2024 public assessment that described Biden as “a healthy, active, robust 81-year-old male” capable of fulfilling presidential duties. The committee says it wants to understand whether that report was accurate — or politically motivated.
“Given your connections with the Biden family, the Committee sought to understand if you contributed to an effort to hide former President Biden’s fitness to serve from the American people,” Comer wrote.
The Oversight Committee is focusing on Biden’s health evaluations in the context of several public stumbles and reports of increasing reliance on aides behind the scenes. Lawmakers are now examining whether O’Connor’s evaluations were influenced or coordinated with senior staff.
The deposition is part of a larger investigation into alleged misconduct during the final months of the Biden presidency, including a separate inquiry into the use of an autopen — a mechanical signature device — on official documents such as pardons and executive orders. Some lawmakers argue that this raised questions about Biden’s direct involvement in presidential decision-making.
President Biden addressed the matter publicly this week, stating:
“Let me be clear: I made the decisions during my presidency… Any suggestion that I didn’t is ridiculous and false.”
He also accused Republican lawmakers of pursuing the probe as a political distraction.
Despite that response, GOP lawmakers insist the public was not given a transparent account of Biden’s condition and decision-making ability in the final stages of his administration. The committee is expected to issue additional subpoenas as the investigation continues.
