AOC Reportedly Under Federal Investigation for Hiring Undocumented Staffer and Aiding ICE Evasion

Rep. Alexandria Ocasio-Cortez is reportedly under federal investigation after claims surfaced that she employed an undocumented immigrant on her congressional staff and hosted events that may have helped individuals avoid federal immigration enforcement.

The allegations were made public by former acting ICE Director Tom Homan during an interview on the Benny Johnson Show. Homan confirmed that U.S. Immigration and Customs Enforcement (ICE) is reviewing two separate cases tied to the New York congresswoman.

Federal Review in Progress

When asked if Ocasio-Cortez was being investigated for employing an undocumented worker, Homan responded, “It’s being looked at… I’m aware of it. We’ve asked ICE to drill in on that case.” He declined to offer further comment due to the sensitivity of the matter.

The staffer in question, Diego de la Vega, reportedly served as deputy communications director in Ocasio-Cortez’s congressional office and worked on her 2021 re-election campaign. According to reports from The Gateway Pundit, de la Vega self-deported to Colombia in December 2024, shortly after former President Donald Trump’s return to office.

Possible Violation of Federal Law

Homan also stated that Ocasio-Cortez may have crossed a legal line by holding virtual events that guided undocumented immigrants on how to avoid detection or arrest by ICE agents.

“She’s really educating them on how to avoid prosecution,” Homan said. “When you knowingly hinder removal, that’s a crime. We’ve instructed ICE to start prosecuting these cases.”

Escalation to the DOJ

This is not the first time Homan has raised concerns. During a February appearance on Fox News’ The Ingraham Angle, he stated that he had contacted the Deputy Attorney General to formally assess whether Ocasio-Cortez’s actions constitute obstruction of federal enforcement.

“At what level does that obstruction occur?” Homan asked. “Is she overstepping her bounds? That’s a question for DOJ.”

No Response From AOC

As of now, Ocasio-Cortez has not issued a formal statement regarding the investigation. In a past comment to Migrant Insider about de la Vega’s departure, she simply said, “Diego is incredible. We appreciate him.”

Her office has not responded to requests for clarification.

Immigration Enforcement Under Renewed Focus

The Trump administration has made immigration enforcement a top priority since returning to power. Border crossings have dropped sharply, and officials like Homan have vowed to pursue legal consequences for anyone obstructing enforcement efforts, regardless of their office.

The outcome of this investigation could have wide-reaching implications, especially if charges are filed. For now, all eyes are on ICE and the Department of Justice.
