New Arrests and Charges
The DOJ accuses the defendants of assaulting federal officers, committing felony arson, vandalism, and disobeying lawful orders.
Nadya Sofia Malinowska, 33, of Portland—formerly Marek Greger Belka—faces three counts of failing to obey lawful police orders. Specifically, court records show Malinowska refused police commands to leave federal property during protests on June 17, 21, and 29. Consequently, authorities arrested her on June 29 and placed her in federal custody.
Malinowska, a transgender woman and member of the Portland band “Moth Kit,” legally changed her gender in May 2023. Interestingly, several others charged in connection with the ICE occupation also identify as transgender.
David Pearl, 35, from Portland, stands charged with failing to obey lawful orders and creating a disturbance. Moreover, authorities say Pearl interfered with Malinowska’s arrest on June 29 and took him into custody.
Arson and Assault Allegations
Trenten Edward Barker, 34, who identifies as trans nonbinary, faces felony arson and depredation of federal property charges. Authorities accuse Barker of setting fire to the ICE facility, which lies near an elementary school.
August Dean Gordon, 31, of Beaverton, Oregon, faces federal charges for willful depredation of government property and assaulting federal officers. According to court documents, Gordon physically attacked five federal officers during his arrest on June 29, kicking officers and grabbing them aggressively, leaving one officer bloodied.
Federal Response and Ongoing Occupation
So far, law enforcement has arrested more than 20 individuals during the 24-hour Antifa occupation at the ICE facility. Protesters face charges ranging from assault with weapons to using high-powered lasers against officers. Furthermore, they set fires and trapped federal agents inside the ICE office using devices.
The DOJ vows to hold all violent protesters accountable and continue protecting federal officers and property.
