Federal investigators have launched a probe into Rep. Alexandria Ocasio-Cortez (D-NY) over explosive allegations that she employed an illegal immigrant and may have helped others avoid arrest by U.S. immigration agents.
Former ICE Director and current Border Czar Tom Homan confirmed during an interview with conservative podcaster Benny Johnson that his office is actively investigating AOC for two serious offenses: employing an undocumented individual on her staff, and facilitating efforts to help illegal immigrants evade Immigration and Customs Enforcement (ICE).
“It’s being looked at,” Homan said. “We’ve asked ICE to drill in on that case. If you knowingly hinder your removal or someone else’s, that’s a crime.”
The undocumented individual in question, Diego de la Vega, has a long history of political involvement despite his immigration status. In 2022, he was appointed by AOC as Deputy Communications Director, even after serving as a legislative aide and intern for other Democratic lawmakers. He left the U.S. voluntarily earlier this year, citing fear of deportation under the Trump administration.
Critics are now raising serious national security concerns over how an undocumented immigrant could have been employed in Congress, possibly gaining access to sensitive or classified material.
AOC has denied any wrongdoing and called the investigation “politically motivated.” Speaking to Fox News, she said, “I’ve submitted a formal letter to the administration, and they refuse to respond. I was informing people of their rights — that’s a First Amendment issue.”
The controversy also centers around a “Know Your Rights” webinar hosted by AOC earlier this year. The session advised undocumented immigrants not to open the door for ICE agents without a judicial warrant and encouraged them to seek pro bono legal support. Critics say the event crossed a legal line by actively helping individuals avoid lawful detention.
AOC’s office even offered privacy release forms to undocumented attendees, potentially allowing her team to intervene in deportation proceedings.
Homan has formally asked the Department of Justice to investigate. If evidence confirms that AOC knowingly employed an undocumented worker and encouraged ICE evasion, she could face serious legal consequences.
With the 2026 midterms looming and immigration a top political issue, this developing investigation could prove to be a pivotal moment in the national debate over border enforcement and congressional accountability.
