During a heated House Judiciary Committee hearing this week, Rep. Jasmine Crockett (D-TX) ignited a political firestorm by questioning former First Lady Melania Trump’s legal path to U.S. citizenship — specifically her use of the prestigious EB-1 visa, often referred to as the “Einstein visa.”
The EB-1 visa is typically reserved for individuals with extraordinary ability in their field — such as Nobel Prize winners, Olympic medalists, or internationally acclaimed experts in science, education, or the arts. Crockett used the opportunity not just to scrutinize Melania Trump’s qualifications but to accuse Republicans on the committee of blatant hypocrisy regarding their stance on immigration policy.
“The First Lady, a model — and when I say model, I’m not talking Tyra Banks, Cindy Crawford, or Naomi Campbell — applied for and was given an Einstein visa,” Crockett said, drawing audible reactions from both sides of the aisle. “Let me tell you how you receive that kind of visa: You’re supposed to have internationally recognized success, not just appear in fashion magazines.”
Crockett went on to suggest that Melania Trump’s immigration history has long been swept under the rug by GOP lawmakers who claim to champion strong border security and lawful immigration standards. She accused Republicans of lacking “integrity when it comes to the president’s family,” saying their tough talk on immigration conveniently disappears when it involves someone from their own political circle.
Her comments immediately triggered backlash from Republican members, many of whom accused Crockett of making the hearing personal and using an official platform to attack a former First Lady with no current political role. Some also defended Melania Trump’s career achievements, arguing that her international modeling success and public visibility met the standards outlined for the EB-1 visa.
Legal experts remain divided over whether Melania’s visa status, granted in 2001, met the technical requirements of the EB-1 category. While some argue her modeling career may have qualified under the arts provision, others have long questioned whether the visa was appropriately issued.
The Trump camp has previously dismissed questions about Melania’s immigration status as politically motivated attacks, and this latest exchange is likely to reignite partisan debate over immigration policy and double standards.
